According to TMZ, Drake is being sued for the opening monologue of his Nothing Was the Same track "Pound Cake/Paris Morton Music 2," featuring Jay Z.

The album credits the opening 35 seconds of the track to a 1982 song called "Jimmy Smith Rap" by the late jazz musician Jimmy Smith. However, Drake reportedly never got the proper license to use the clip.

In the lawsuit, the estate of James Oscar Smith, who passed away in February 2005, claims that Drake never asked their permission; therefore, they never gave him their permission. However, the liner notes suggests that the clip was licensed. It reads: "Featuring samples from the Jimmy Smith recording "Jimmy Smith Rap" produced under license from Atlantic Recordings Corp., by arrangement with Rhino Entertainment Company, a Warner Music Group Company. Speech sample provided by Christian Rich & Utters."

As TMZ notes, the estate is targeting Drake and Cash Money Records, among others. They want $300,000.
