Rapper Sean "Diddy" Combs is facing many allegations accusing him of misconduct throughout his career. One of the most notable ones came in the form of a sexual assault case filed by Liza Gardner.

Gardner alleged that Combs and singer Aaron Hall had sexually assaulted her when she was still 16 years old in 1990 in New York. Now, the accuser had reportedly obtained crucial evidence that could incriminate Combs.

In court documents obtained by AllHipHop, it was learned that Gardner, through her lawyer, Tyrone Blackburn, has sought the presiding judge to voluntarily discontinue her sexual assault case in New York without prejudice as she intends to refile it in New Jersey. Legally, asking a judge to dismiss a case without prejudice means that the case can be dismissed but can still be refiled at a later point.

Blackburn wrote to Judge Richard G. Latin that his client, Gardner, had received new information from several witnesses that could add context to his client's claims and eventually clarify the case's timeline.

"The first and second witnesses have photos of Plaintiff and Defendant Aaron Hall from the day of the assault, which was taken a few hours before he raped Plaintiff. The first and second witnesses also confirmed that the sixteen-year-old plaintiff was assaulted at the MCA event in New York City, went to dinner in New York City, and then was taken to New Jersey, where the rape occurred," the filing wrote, explaining the need to refile it on New Jersey City, instead of New York. "The former employee confirmed that Aaron Hall was an employee of MCA at the time of the rape."

In 2023, Gardner was one of the many people who came forward and sued the rap mogul for sexual assault. She also accused him of battery and negligent infliction of emotional distress. In her recollection, she and another friend were sexually assaulted by Diddy and Hall in 1990 when she was still 16 at the time.

"While at Hall's apartment, Liza Gardner was offered more drinks and was coerced into having sex with Combs. After Combs finished doing his business, Liza Gardner laid in bed, shocked and traumatized. As she was in the process of getting dressed, Hall barged into the room, pinned her down, and forced Liza Gardner to have sex with him. After Hall finished raping Liza Gardner, she quickly got dressed and ran out of Hall's house. Her friend left shortly after," Gardner's filing said.

In April 2024, Blackburn was accused of "improperly" filing cases in court to attract media attention and "embarrass defendants." He was also referred to a New York court grievance committee to investigate whether he had violated court rules.
