Both Kesha and Dr. Luke's camps have sent letters to the court, heading to a potential trial set to commence in February the following year, Rolling Stone and Pitchfork reports.

Kesha's legal team wrote that Dr. Luke, whose real name is Lukasz Gottwald, and his legal team refuse to comply with the briefing deadlines for October or November, thus delaying the process, reports say.

Stand Still

Anton Metlitsky, one of Kesha's lawyers, wrote in the statement: "The trial absolutely cannot proceed unless the issues presented in these appeals are resolved," and asked the court to proceed with the hearing of the "Tiktok" singer's appeals in November.

Christine Lepera, one of Dr. Luke's legal team, has responded to this statement, noting that the singer's appeals would be heard and would "proceed in the normal course of briefing and argument."

However, a November hearing might not push through, given that Lepera's team has conflicting schedules.

Despite the delay in the appeals in the case, Lepera claims that she is still ready to push through with the trial. On the other hand, Kesha's camp refuses to do so until all of it is resolved.

"It would be a monumental waste of party and judicial resources to proceed to trial when there is a very real risk that a new trial immediately would be required, as would be the case if the Court of Appeals reverses as to any of the several questions currently before it," wrote another of Kesha's lawyers Leah Geodesy, address to a New York judge.

Kesha's legal team is adamant that the appeals be heard out, so that they may proceed to the trial in February.

"Kesha has an overwhelming interest in having the trial proceed as scheduled on February 20, 2023, not only so that she can seek vindication but also so that she can get this ordeal behind her and move on with her life," Godesky wrote.

The Root Of It All

In October of 2014, Kesha filed a highly controversial lawsuit against the producer, claiming sexual assault and battery. She cited an incident that allegedly happened in October of 2005 wherein Dr. Luke allegedly gave the singer a date-rape drug and "raped her while she was unconscious."

Aside from this, Kesha also alleges that Dr. Luke caused her to suffer bouts with her mental illness, stemming from emotional and psychological abuse.

Following Kesha's suit, the producer filed his countersuit, accusing Kesha, her mother, and her manager of defamation. He also denied all the accusations against him.

In 2015, Kesha added Sony to the mix, claiming that they knew of the alleged abuse, but did nothing to stop or prevent it.

Reports say that Sony responded to these accusations and claimed that they were simply "caught in the crossfire" between the singer and producer.

In 2016, Dr. Luke broke his silence regarding the issue, tweeting: "they are getting behind an allegation only-motivated by money."

He denounced the claim that he had raped the singer, and added that they had a brother-and-sister-like relationship.
