A federal judge in Los Angeles dismissed one of the three remaining sex abuse lawsuits filed against shock rocker Marilyn Manson on Tuesday because the plaintiff, Ashley Morgan Smithline, missed a crucial deadline. On October 5, the court granted Smithline's former attorney permission to withdraw from the case.

The court then gave Smithline two months to hire new counsel or file a status report stating she was prepared to represent herself in order to keep the case alive.

She did not respond. In June 2021, Smithline initially filed suit against Manson, born Brian Warner. She alleged that between mid-November 2010 and January 2013, the musician obsessively pursued her online, convinced her to visit him in Los Angeles, and then bound and raped her, choked her, put a pillow over her face, and cut her during multiple assaults.

Warner, 53, denied any wrongdoing, claiming that his interactions with Smithline and other accusers were either consensual or did not occur. 

Warner still faces two additional sex assault lawsuits from Game of Thrones actress Esmé Bianco and a Jane Doe who alleges Warner brutally raped her at his home in 2011 following a tumultuous relationship. A fourth lawsuit filed by Ashley Walters in May 2021 was dismissed by a judge due to the statute of limitations last year.

Walters appeals the decision. Walters alleged in her complaint that Warner subjected her to "sexual exploitation, manipulation, and psychological abuse" for more than a year after luring her to his residence in May 2010 with the promise of a professional collaboration.
