Dua Lipa is facing the third lawsuit for her song "Levitating." The smash hit has been the subject of two equally controversial lawsuits in the past which she has successfully won.

Another complainant has come forward and alleged that he did not give Dua Lipa permission to use one of his original productions.

Dua Lipa 'Levitating' Sued Again: Here's Why

According to Billboard, Dua Lipa's July 2023 ended with a new lawsuit, her third, in fact, for her hit song "Levitating."

A producer named Bosko Kante claimed that he created a so-called "talk box track" to be used in the original version of the song. However, creators of the song had no right to use the said "talk box track" in other remixes, including the one with DaBaby.

"Plaintiff made numerous attempts to resolve this matter short of litigation, but such efforts were unsuccessful, due to Defendants' unwillingness to cooperate or accept responsibility for this blatant infringement of Plaintiff's copyrights," the suit reads.

Apparently, Kante claims to be "one of the world's top artist on talk box." For those who do not know what a talk box is, it is a "decades-old" device that converts speech sounds onto a sound of an instrument.

He said he contributed to Kanye West and Big Boi's talk box performance. In 2014, he sold his company ElectroSpit to sell propriety digital versions of the device.

In his lawsuit, Kante claimed that Stephen Kozmeniuk, one of "Levitating's" producers, approached him in 2014. He said he was asked to create a talk box performance that would be used in Lipa's song - "Levitating."

However, it should be noted that they only reached an "oral agreement" for the track.

Kante furthered that the deal did not specify that it could be used on other remixes for the track other than the original release. This meant that Warner and Lipa does not possess the right to use the said talk box on the version with DaBaby or the one with Madonna and Missy Elliott.

Dua Lipa 'Levitating' Billboard Hot 100

Released in "Future Nostalgia," "Levitating" peaked at No. 2 on the Billboard Hot 100 charts, but it ranked No. 1 on the year-end charts of Billboard in 2021.

It has since been certified 4x Platinum by the Recording Industry Association of America (RIAA).
