Grimes and Elon Musk are fighting over custody of their children in a tug-of-war of lawsuits. Now, the Canadian singer wants to scrap Elon Musk's lawsuit against her.

Grimes, Elon Musk Custody Battle Update

According to a new filing obtained exclusively by Page Six, Grimes claimed that she and her kids did not live in the same household in Texas until July 2023, contrary to Elon Musk's claims in his filing.

Musk says that Grimes and their children lived in the same household in Texas from May until July 2023. However, in Grimes' new filing, she says that they moved to California on or about Dec. 31, 2022, also argued that Musk spent a huge amount of time on the West Coast during the said period, even spending two to three days a week back then.

The CEO maintained that he was in Austin, Texas "about 46 percent" of the time. (via Business Insider)

"The court's assumption of jurisdiction in this proceeding is inappropriate due to the specific facts and circumstances of the parties to this suit, and would offend traditional notions of fair play and substantial justice," she said in the filing.

In Grimes' initial lawsuit, she wanted to establish legal guardianship for her children because Grimes and Musk weren't actually married when she had them.

Grimes claimed that she has not been in contact with her children for a long while as it was in Musk's care.

"tell Elon to let me see my son or plz respond to my lawyer," she said in a tweet.

Meanwhile, Musk claimed that he had taken"actual care, control and possession of each child since the birth of each child," pointing out that he did it in Texas at least "six consecutive months." Grimes also said in her filing to have physical custody of the child and a restraining order for Musk to prevent him from moving the children out of California.

While the legal battle is expected to be hairy, a Texas judge advised that they go on mediation sessions first before engaging in trial.

Unknowingly, Musk first filed the paperwork in establish parental rights on their children, but it was only publicized days after Grimes went public with it.

Elon Musk filed his paperwork for the lawsuit on Sept. 13, 2023, while Grimes, filed hers on Sept. 30, 2023, weeks apart.
