There had been a glimmer of hope when one of the main eye witnesses in the murder case against rap mogul Suge Knight flip-flopped on his story and decided not to testify about the alleged murder of the victim, Terry Carter. Despite the flip-flop by the witness, Cle "Bone" Sloan got into an alternation with Suge Knight and was run over by the Death Row Records founder just moments before Knight allegedly ran over Carter. Sloan refused to testify about the incident at a preliminary hearing in April and thus, Knights attorneys moved to try and dismiss the case. Today, July 7, Superior Court Judge Stephen A. Marcus rejected that as a good reason to dismiss the case.

Judge Marcus said he could not evaluate the credibility of the witness based on a preliminary hearing, noting, "He doesn't say that it's not him." He also cited evidence that Sloan and Knight had bad blood between them for years, calling the fight between them the latest act in an ongoing "soap opera." "The only person who had a motive was Suge Knight," according to CBS.

Sloan initially told detectives that he had repeatedly punched Knight through the window of his pickup moments before he was run over. After hitting Sloan, Knight ran over and killed Terry Carter, according to investigators.

Knight's attorneys have said that their client was ambushed and he was fleeing the attack when he ran over Carter in the Compton burger joint's parking lot. Knight is currently being held on $10 million bail, which is lawyer Thomas Meserau has repeatedly tried to reduce.

Thus the pre-trial back and forth continues, but it looks as though Knight is increasingly running out of options to avoid a trial.
