Melissa Rivers has finally, officially filed a malpractice lawsuit against the Yorkville Endoscopy Clinic and everyone who played a part in her mother Joan Rivers's untimely death last September, according to Fox Business. In the suit, lawyers for Melissa claim that each staff member acted more like a groupie doctors than a bunch of caregivers, and when it was clear there was an emergency, Joan's personal doctor left the room in an attempt to distance herself from the mistakes that had been made.

Thankfully, terrorism appears to not have contributed to the crash of AirAsia Flight 8501 into the Java Sea a few weeks ago. Divers discovered the black boxes last week and have begun to evaluate the information they contain. According to Indonesian officials, they believe they can safely say that terrorism was not a factor that contributed to the loss of 163 lives on board the aircraft.

  • Clinic Where Joan Rivers Suffered Cardiac Arrest Losing Funding

    The Yorkville Endoscopy Clinic where Joan Rivers suffered complications during a procedure is dealing with another strike against it today, Jan. 12. New York State's Department of Health and Human Services originally launched an investigation against the clinic shortly after Rivers's death in September and found a number of things wrong. The clinic was originally cited for leaving patient records in clear view and for a staff member taking cellphone photos of the comedienne while she was under sedation. Now we are learning that it has lost federal funding because it has yet to clean up its act. Yorkville was also originally found non-compliant in providing proper follow-up care for patients who had been under anesthesia, and it was given time to correct its errors. As it turns out, Yorkville has not met the deadline to clean up its business practices and, because of that, it will officially lose federal funding beginning Jan. 31. As of that date, the clinic can no longer accept Medicare as a form of payment, so any of their current patients who are covered under Medicare need to start shopping for new doctors now. Last week, we learned that Yorkville's former medical director, Dr. Lawrence Cohen, once wrote a paper regarding his belief that having an anesthesiologist on staff for endoscopic procedures is not "cost effective" and basically is unnecessary. Even with the extra hands and eyes on staff, Cohen still could not get Rivers safely through what was considered a routine procedure.

  • Ma$e Loses Cover Art Suit Over Instagram Pic After Performance for Crowd of Less Than 50 in London

    Former Bad Boy rapper Ma$e has been ordered to pay after losing a cover art lawsuit over an Instagram photo. The news comes on the heels of the rapper's underwhelming performance for a crowd of less than 50 people in London. According to reports, model Stephanie Delgado accused the Harlem rhymer of appropriating an Instagram photo of hers and using it as the cover art for his single "Why Can't We" without permission. Following her accusations in April, Delgado sued Ma$e over her claim. As noted by "TMZ," Ma$e was ordered to pay her $7,500. Delgado was reportedly awarded the money in default as Ma$e apparently never responded to her claim. Delgado was originally seeking damages in the area of $60,000, but was not awarded that sum because she was unable to prove earnings matching what she was asking for in previous photo shoots. Just last month, Ma$e was forced to perform in front of an intimate-sized crowd after fellow New Yorkers Fat Joe and Foxy Brown dropped out of their London gig. Joe was not able to get in the country and Brown pulled out with no explanation. The "Ill Na Na" rapstress jumped on Instagram during the performance and took shots at Ma$e's underwhelming crowd. She did not mention why she bailed on performing, though.

    Remember how Teresa Giudice stood before the judge in open court in early October and said she was ready to take full responsibility for her bad business decisions that resulted in her and husband Joe Giudice defrauding just about every business partner they have had in the last several years? Well, scratch that because it looks like Teresa was more interested in saying the right thing in the hopes of getting out of a prison stint. It did not work, as "The Real Housewives of New Jersey" star is expected to turn herself in to begin serving 15 months Jan. 5, but she has decided to play the blame game before she goes away. Teresa has filed a $5 million lawsuit against her bankruptcy attorney James Kridel, basically blaming his ineptness for her being sentenced to prison. A list of assets had been requested by the court, and while it was submitted — late — it was also missing numerous things, such as property and luxury items owned by the Giudices. When they arrived for sentencing in October, they were vilified for not reporting everything and concealing assets right up to the end, which may have been the thing that prompted the judge to throw the proverbial book at Teresa. It is also a convenient way for the reality star to shift the blame onto someone other than herself, and that is exactly what she is attempting to do with Kridel. Plus, she is now broke and still has to pay back more than $200,000 in restitution as part of her sentencing, so Teresa is really desperate to generate cash flow from wherever she can, and she knows that her options are limited.

  • Joan Rivers's Doctors Waited 14 Minutes As Vitals Crashed Before Calling 911

    Slowly but surely, as time goes on we are learning more about the simple endoscopic procedure that ultimately resulted in the death of Joan Rivers in September. In late August, the comedienne checked into the Yorkville Endoscopy Clinic in Manhattan to have a simple, routine procedure done. As pieces of the puzzle have been put together, it now seems that not only was Rivers given far too much Propofol to sedate her, but that her doctors continued to scope her even when her vitals dropped to dangerous levels. According to a new report by Page Six, workers at Yorkville waited for 14 whole minutes before calling 911 after she went into shock. Rather than stopping their procedure, Drs. Lawrence Cohen and Gwen Korovin continued to scope Rivers's larynx rather than begin to administer CPR. When they reportedly did begin trying to resuscitate Rivers, they wasted 10 minutes in failed attempts before calling in additional help. All of these little details are no doubt devastating to Rivers's daughter Melissa Rivers. They will also only help to bolster the malpractice lawsuit that she already has hired a bulldog law firm putting together. Rivers may have been in her 80s, but it has become painfully clear that her death was unnecessary at this particular point in time.

    Fans of "Love & Hip Hop Atlanta" were surprised recently to learn that Benzino and his love, Althea Eaton, were handed their walking papers from VH1's hit show. The firing came after a reunion show taping that turned violent when the always iffy Joseline Hernandez went nuclear on Zino and punched Eaton before taking extra shots at a few other cast members as well. Eventually, Hernandez and her man Stevie J were escorted from the building and the rest of the cast continued on, mainly discussing what addicts the two are. At the time it looked likely that they would be fired, as everyone was in complete agreement about how crazy violent Hernandez had become. Instead, Benzino and Eaton were canned and it is reportedly his fault. According to a new report by TMZ, Stevie J went to the producers and claimed that Zino had started a smear campaign that ultimately turned into flat-out death threats against himself and Hernandez. Stevie J is insisting that it was those threats that actually got Zino and Eaton fired because they were far worse than Hernandez's messiness and violent tendencies. Zino has yet to clap back and comment, but it is coming because he does like to take his gripes with anything related to "Love & Hip Hop Atlanta" straight to Twitter.

  • Tracy Morgan's Career in Doubt as He Attempts to Recover from Brain Injury

    Five months after actor-comedian Tracy Morgan's limo bus was struck by a speeding Wal-Mart truck on the way back from a gig at a Delaware casino, we are learning more details about the devastating accident. Morgan is thought to be fortunate to have survived the accident that killed fellow comedian James McNair because he suffered a subdural hematoma, which kept him comatose with bleeding around his brain. Morgan and three others have filed a lawsuit against Wal-Mart, and attorneys for both sides met behind closed doors yesterday. Morgan's attorney, Benedict Morelli, gave the press an update on Morgan's condition and a realistic view of his prognosis. "He's fighting to get better, and if there's a chance for him to be back to the Tracy Morgan he once was, he's going to try to do that. He's still fighting and trying to live his life at the same time and trying to get better, and he's just not better. We're hoping and praying to get him back to where he was. But the jury's out. He had a very, very bad brain injury. Let's assume for a moment that he can go back and do everything that he was able to do before. When is that going to be? A year from now? Two? Three? I don't know. Six months? I doubt it," said Morelli.

  • NY Health Dept. Believes Yorkville Clinic Broke Protocol Before Giving Joan Rivers Double Dose of Propofol

    It sounds like New York's Department of Health and Human Services has just made Melissa Rivers's malpractice suit a whole lot easier. As we recently told you, Melissa has hired a high-powered Manhattan law firm to represent her on behalf of Joan Rivers's estate. Page Six said Joan checked herself into the Yorkville Endoscopy Clinic Aug. 28 for what was intended to be an exploitative procedure and went into cardiac arrest while sedated with Propofol. According to the agency, the clinic screwed up by not dosing Joan properly. Propofol's dosage is dependent upon a patient's weight and, apparently, Yorkville never bothered to weigh Joan. According to an explosive report by TMZ, a staff member told the New York agency that they made a mistake while inputting the proper dosage into the computer and that Joan was given double the dosage of what is safe for a woman of her size. Not only did they screw up the medication, but the report also alleges that if Joan had been as closely monitored as a patient under Propofol is supposed to be, then staffers would have realized she was starting to die right in front of them! Instead, by the time the two doctors and team of nurses in the room realized what was happening, she was already in full cardiac arrest.

In 2010, Jose Lopez filed a lawsuit against the Watchtower Bible and Tract Society of New York claiming that he was molested back in 1986. A San Diego judge believed his story and on Friday awarded him $13.5 million in restitution.

    We told you last week about a fight that occurred between Melyssa Ford and Geneva Thomas while they were filming 'Blood, Sweat & Heels,' their reality show on Bravo. Apparently the ladies got into a verbal fight that turned violent and ended with Thomas smashing a bottle over Ford's head. The on-camera assault left Ford in need of stitches and a hospital bed. The incident caused Thomas to be painted as violent so she has filed a $25 million dollar defamation suit.

One minute everyone was seated and the next, Hernandez was charging the stage at Eaton and it was downhill from there.

  • Amber Vinson Released from Hospital after Being Declared Ebola-Free, Retains Attorney

    Today is no doubt one of the happiest of Amber Vinson's life, as she was discharged from Emory Hospital in Atlanta earlier today after being declared healthy. Vinson was the second Texas nurse infected with the Ebola virus after caring for Thomas Eric Duncan, who died from the illness Oct. 9. She eventually was transferred out of Texas Health Presbyterian Hospital in favor of Atlanta's Emory facility, one that had previously treated Ebola patients, and it is the excellent care she received there that eventually nursed her back to health.
