Tory Lanez appealed to an appellate court to disqualify the presiding judge of his assault trial against Megan Thee Stallion. However, in a new report, Lanez was denied of his new motion.

Despite his failure to disqualify and file for a new trial, Lanez was successful on one front; he delayed his sentencing trial.

Tory Lanez Failed To Disqualify Presiding Judge

In a tweet from legal reporter Meghann Cunniff, she revealed that Tory Lanez was denied for his motion to disqualify Judge David Herriford after rejecting his new motion for a new trial.

Lanez, formally known as Daystar Peterson, filed for a motion for a new trial after dubbing his recent conviction as a "miscarriage of justice."

In Cunniff's tweet, she posted a screenshot of the actual court document stipulating such a denial.

"The petition for writ of mandate and request for stay are denied for failure to demonstrate entitlement to extraordinary relief," the document read.

Supposedly, Tory Lanez will be given his sentence on Jun. 13, 2023. However, because of the motion, the new date has yet to be announced.

"It seems like the judge will be granting the continuance over our objection," the Los Angeles District Attorney said in a statement. "No confirmed new date yet."

Judge David Herriford Denied Bias, Prejudice Against Tory Lanez

As quoted by AllHipHop, Judge David Herriford firmly stood by his impartiality on the trial.

"I am not prejudiced or biased against or in favor of any party to this proceeding or their counsel," he said in a statement. "All rulings made by me in this action have been based upon facts and arguments officially presented to me and upon my understanding of the law. All statements made by me and all actions taken by me in this proceeding have been done in furtherance of what I believe were my judicial duties."

Tory Lanez was convicted in 2022 for three counts of felony - assault with a semiautomatic firearm, discharging a firearm with gross negligence, and carrying a loaded, unregistered firearm in a vehicle.

Lanez could be sentenced to 22 years to eight months in prison if it is decided that he gets the maximum sentence. He could also get deported as he was a Canadian citizen.
