• Ex-NYC Mayor Rudy Giuliani: Darren Wilson's Case Should Never Have Been Before a Grand Jury

Former New York City Mayor Rudy Giuliani really gets heated when the topic of Ferguson comes up. In the last few weeks he has popped up on various news programs, insisting that while this case took on racial overtones early on, the problem actually starts with what is wrong within the community itself. Giuliani insisted on "Fox News Sunday" that Darren Wilson's shooting of 18-year-old Michael Brown never should have made it in front of a grand jury in the first place. "I don't see how this case normally would even have been brought to a grand jury. This is the kind of case — had it not had the racial overtones and the national publicity — where a prosecutor would have come to the conclusion that there is not enough evidence to present to the grand jury. [U.S.] Attorney General [Eric] Holder's gonna have to take a case in which a jury couldn't find probable cause to indict, and he's gonna have to try to find probable cause in front of a federal grand jury. It's an impossible case to present to a grand jury," said Giuliani. He also held firm to the notion that it is the community's job to get itself together and to work to bring the violence down among themselves. While it is the local police department's job to protect the peace, if people were treating each other humanely in the first place, then situations like Ferguson would rarely occur.

  • AC/DC Respond to Phil Rudd's Legal Woes: Arrest Won't Affect Album, Tour

Some heavy news surfaced last night, Nov. 5, when outlets began reporting that AC/DC drummer Phil Rudd had been arrested in New Zealand on charges of trying to procure the services of a hit man. The band recently responded to the incident in a brief statement via Facebook. "We've only become aware of Phil's arrest as the news was breaking," the post, which went up around 9:30 a.m. today, Nov. 6, reads. "We have no further comment. Phil's absence will not affect the release of our new album 'Rock or Bust' and upcoming tour next year." Rudd also faces charges of possession of methamphetamine and cannabis. Police raided the famous drummer's home in New Zealand, where he has lived for more than 30 years, early Thursday morning local time. He appeared in court and did not enter a plea after being charged. New Zealand news outlet "The Sun" reported that Rudd was "accused of procuring murder" sometime between Sept. 25 and 26. The percussionist is scheduled back in court Nov. 27.
  • Police Say Sash Alexander Nemphos, 16, Planned Maryland School Shooting on Halloween But Too Drunk to Do It

Just a few short weeks after Jaylen Fryberg opened fire on a table full of his closest friends at Marysville-Pilchuck High School in Washington state, we are learning that another school came close to having a similar tragedy. On Saturday, Nov. 1, 16-year-old Sash Alexander Nemphos was confronted by police after being a suspect in several Monkton, Maryland, area theft cases. The teen was clearly intoxicated at the time and unveiled a plan involving a gun that he was accused of stealing. Nemphos claimed he was going to drive to school, shoot the officer who stands guard and then use his gun to kill as many kids and teachers as possible. He then told investigators he had originally intended to carry out his plan on Halloween because he had the gun in his backpack but had forgotten to bring several bombs he had built, so he postponed his plan. He chalked up his forgetfulness to being too drunk on that particular day.
  • Mommy Blogger Jillian Meredith McCabe Admits to Throwing Autistic Son, 6, Off Oregon Bridge

Several months ago, mommy blogger Jillian Meredith McCabe launched a crowdfunding campaign to help her take care of her family, which included her 6-year-old autistic son London McCabe and her husband Matt. Matt McCabe was recently diagnosed with MS and a mass in his brain stem leaving him not only unable to work but unsure if he would recover at all. The family was apart for awhile, but just last month they were back together in time for London's final birthday. On Monday, Nov. 3, Jillian called police after throwing London off a 100-foot historic bridge in Oregon. A little after 6 p.m. last night, Jillian reportedly called 911 and told the emergency dispatcher, "I just threw my son over the Yaquina Bay Bridge."
  • Relative Who Owns Gun Used by Jaylen Fryberg in School Shootings Could Face Homicide Charges

It is going to take Washington state investigators months to even begin to try and fully understand why Jaylen Fryberg was capable of carrying out school shootings at Marysville-Pilchuck High School Oct. 24 that left three close friends dead and two of his cousins fighting to recover. The cafeteria shooting was carried out with a Beretta handgun that was legally purchased by and registered to one of Fryberg's relatives. We are learning now that investigators will be looking closely into how Fryberg was able to access the gun, and if it was not under proper lock and key, then there is a chance the weapon's owner could be eventually facing negligent homicide charges. "Radar Online" recently did some extra digging, and a Seattle-area attorney explained that while a solid law is not on the books, if the weapon was left in a careless place then the owner could still be successfully criminally charged.

  • Oscar Pistorius Sentenced to 5 Years in Prison for Valentine's Day Killing of Reeva Steenkamp

Just two years ago, Oscar Pistorius was best known for being an Olympic track-and-field star most commonly referred to as "the blade runner." Now that same man has been sentenced to five years behind bars for the Valentine's Day 2013 killing of Reeva Steenkamp. Judge Thokozile Masipa is known for delivering harsh sentences, so many were surprised when she tossed out a murder charge in favor of culpable homicide, but from the start of this morning's proceedings in South Africa it was clear Pistorius was going to prison.
  • Human Remains Found May Belong to Hannah Graham as Investigators Work to Tie Jesse Matthew to Several Crimes

University of Virginia student Hannah Graham was first reported missing five weeks ago, and over the weekend a significant finding turned this open case into a death investigation. Sgt. Dale Terry of the Chesterfield Sheriff's Department was with a small search team ready to call it a day when they made a gruesome discovery. Behind an abandoned home nearly 8 miles from where Graham was last seen, Terry and his team discovered a skull and bones scattered across a creek bed with a pair of black pants nearby. While it will take forensic testing to be certain whether these are the remains of Graham, a continued search for her has been called off. Investigators are also working to tie Jesse Matthew to several crimes.
  • Penalty Retrial Jury to Be Seated Next Week in Jodi Arias Trial as Defense Team Fights to Get Death Penalty Off the Table

Selecting a jury in the penalty retrial of convicted murderer Jodi Arias has been easier than many first anticipated. Arias was found guilty of murdering her on-again/off-again boyfriend Travis Alexander in June 2008. Arias changed her story several times while on trial, but what was clear was that stabbing Alexander 30 times, slitting his throat and then shooting the victim seemed like a display of overkill rather than self-defense. Jurors originally agreed and convicted Arias, but then the case went sideways during the first penalty phase. Some 300 potential jurors were interviewed for the second shot at a penalty phase in Arias's case, and the official panel is expected to be seated Tuesday, Oct. 21. Her defense team is fighting to get the death penalty off the table.
  • South African Olympian Oscar Pistorius To Be Sentenced On Tuesday For Death Of Reeva Steenkamp

After several months of trial and an intense mental evaluation, Oscar Pistorius was finally convicted of culpable murder last September for the shooting death of his then-girlfriend, Reeva Steenkamp. The Olympic blade runner still insists that he believed an intruder was on the other side of that bathroom door when he opened fire, accidentally killing Steenkamp on Valentine's Day 2013. The penalty phase of his sentencing has wrapped up this week with Pistorius' punishment finally being announced next Tuesday. The prosecution is rallying hard for the athlete to be incarcerated.
